Terms of service

These terms set out how you may use the Whalegun service that Whalegun (the "operator") provides at whalegun.com (the "service"), and the rights and duties of the operator and its users.

"Service" means the website and email updates that gather filings published by the US Securities and Exchange Commission, the US House and Senate and similar public bodies and present them in Korean and English.

"User" means anyone who visits and uses the service under these terms.

"Subscriber" means a user who has registered an email address to receive the service's email updates.

"Member" means a user who has created an account with an email address or a Google account.

"AI chat" means the feature in which artificial intelligence answers a member's questions from information published on the service.

Words not defined here have the meaning given by the applicable law and general practice.

These terms are linked from the foot of every page.

The operator may change these terms within the limits of the applicable law, including the Korean Act on the Regulation of Terms and Conditions and the Act on Promotion of Information and Communications Network Utilization and Information Protection.

Changes are announced on the service at least 7 days before they take effect, with the effective date and the reason. A change unfavourable to users is announced at least 30 days before and emailed to subscribers and members.

If you do not accept a change, you may stop using the service, a subscriber may unsubscribe and a member may delete their account.

Everything published on the service is free for anyone to use without an account or a login. Features for one user, such as saving stocks and people to watch, notifications and AI chat, are for members only.

A user becomes a member by confirming their email address with a sign-in code sent by email or with a Google account, giving their name, date of birth and gender, and agreeing to these terms and to the collection and use of personal information. The date of birth confirms they are 14 or older.

Children under 14 cannot become members.

A member can change their display name, email language and news-mail choice on the settings page.

A member looks after their own email account and Google account, and tells the operator at once on learning that someone else has signed in to their account.

A member can leave at any time with Delete account on the settings page. Deleting an account removes the account, its watch list, notifications and chats at once, and cannot be undone. Sign-in records are kept for the period the privacy policy sets, as the law requires.

If a member breaks article 11, the operator may, after notice, restrict their use or end their membership. Where the service is seriously disrupted, the operator restricts first and gives notice without delay.

The service is provided around the clock as a rule.

The operator may change the content and screens of the service for operational or technical reasons and announces changes that matter to users in advance.

The operator may modify or discontinue all or part of the free service when operations require it.

The operator may interrupt all or part of the service temporarily when equipment needs maintenance or replacement; when a body that publishes the filings or a telecommunications carrier stops its service; when a power cut, equipment failure or surge in traffic makes normal operation impossible; or in case of natural disaster or other force majeure.

Interruptions are announced in advance, or promptly afterwards when advance notice is impossible.

The operator sends the weekly report every Saturday to subscribers who confirmed their address. An address whose confirmation mail was not confirmed receives no report.

Every update carries an unsubscribe link, and a subscriber may unsubscribe at any time through that link or by writing to the contact address.

The operator sends commercial advertising only to subscribers or members who have separately agreed to receive it.

The operator is not a financial investment business or investment adviser under the Korean Financial Investment Services and Capital Markets Act, and the service provides no investment advice, discretionary management, brokerage or trading of financial products.

Everything on the service restates and organises public filings. Nothing is a recommendation to buy, sell or hold any financial product.

The information comes from the bodies that publish the filings and may be late, incomplete or wrong; the operator does not guarantee its accuracy, completeness or timeliness.

Figures the service computes (a first buy in N years, the days before a trade was reported and the like) are calculated by fixed rules from stored filing fields. Past trades and statistics do not guarantee future results.

Your investment decisions and their gains or losses are yours alone.

AI chat answers are information generated automatically by artificial intelligence from what is published on the service. They are not investment solicitation or investment advice.

An answer may be wrong or incomplete. Check it against the trade pages linked in the answer; investment decisions made with an answer, and their results, are your own.

To keep the service stable, the operator may set how many questions one member can send a day, and shows that number in the AI chat.

How AI chat content is handled and kept is set out in the privacy policy.

Rights in the text, layout and compilations the service produces belong to the operator.

Original filings belong to the bodies that publish them; company logos and marks belong to their owners.

You may quote the service for personal, non-commercial purposes with its address. Any other copying or distribution needs the operator's consent.

You must not overload the service with automated requests or otherwise disrupt its operation; bypass its security or access its systems without permission; present its content as your own or use it to solicit investments; subscribe someone else's email address without their consent; sign up or sign in with someone else's email address or Google account; or send excessive questions to AI chat by automated means.

The operator is not liable for failing to provide the service because of events beyond its reasonable control, such as natural disasters, force majeure or outages at the bodies that publish the filings.

The operator is not liable for profits you expected but did not make, or for losses you incur, by using the service's information, except where caused by the operator's intent or gross negligence.

The operator and users will negotiate in good faith to settle any dispute about the service.

These terms and the use of the service are governed by the laws of the Republic of Korea.

If negotiation fails, a lawsuit is brought before the court with jurisdiction under the Korean Civil Procedure Act.
